Certified General Accountant Essay

As a Certified General Accountant (CGA), ethics are a fundamental requirement. CGAs affect the welfare of their clients and also the wider stakeholder-society. It is crucial to work in accordance with the six CGA Canada Code of Ethical Principles. Fraud and negligence do occur however and they have negative implications on the professional, the client, the professional body, and society as a whole. For example, in the case of Kelley Lynch, she was trusted by her client, Leonard Cohen, to work responsibly as his business manager (Malemed). Unfortunately, her activities can be analyzed to demonstrate how she failed to act responsibly and directly violated three ethical principles. Lynch violated the ethical principle of Trust and Duties. As a professional accountant, Lynch failed to honour the trust that her client bestowed upon her and used her privileged position as business manager to cater to her own needs. For example, Lynch conspired with Richard Westin to hire him as Cohen’s tax lawyer in order to cater to her self-interest With Westin’s help, they devised a complex corporate structure as a vehicle for retirement savings. Taking advantage of her privilege to access Cohen’s finances, she stole over $50 million. Another key violation is that she failed to remain independent in mind and appearance, as she was once in a personal relationship with Cohen (Malemed). * * Lynch also violated the principle of Responsibilities to Society. She failed to uphold to responsibilities to society, which include acting with trustworthiness, integrity and objectivity. She failed to display these characteristics in her own actions and in her dealings with her colleague, Westin, while serving her client. For example, Lynch is entitled to 15% management compensation, however she broke Cohen’s trust by stealing more than $5 million of his savings, which is greater than her defined compensation amount. She failed to act with integrity and objectivity, when her client took time off from his career. She used this opportunity to receive more royalties through the scheme that Westin helped to develop (Malemed). * * Lynch also directly violated the principle of Deceptive Information. As a professional accountant, Lynch failed to not be associated with information that is false or misleading. With Westin’s help, Lynch pretended to sell Cohen’s music-publishing company and royalty for $12 million. Lynch falsely stated to Cohen that the money from the sale would go to a company owned by his children, but instead it went to a company almost owned entirely by Lynch (Malemed). * * In conclusion, Lynch failed to act responsibly with handling the finances of her client, Cohen and directly violated at least three of the six ethical principles. This is just one incident of fraud and negligence that has occurred in professional accounting bodies. Therefore, to maintain the integrity and respect of the CGA profession, it is crucial that members always act in accordance with the CGA Canada Code of Ethical Principles.

Dharmodas Ghose Case Essay

Dharmodas Ghose, a minor, entered into a contract for borrowing a sum of Rs. 20,000 out of which the lender paid the minor a sum of Rs. 8,000. The minor executed mortgage of property in favour of the lender. Subsequently, the minor sued for setting aside the mortgage. The Privy Council had to ascertain the validity of the mortgage. Under Section 7 of the Transfer of Property Act, every person competent to contract is competent to mortgage. The Privy Council decided that Sections 10 and 11 of the Indian Contract Act make the minor’s contract void. The mortgagee prayed for refund of Rs. 8,000 by the minor. The Privy Council further held that as a minor’s contract is void, any money advanced to a minor cannot be recovered. JUSTICE SIR FORD NORTH On July 20, 1895, the respondent, Dharmodas Ghose, executed a mortgage in favour of Brahmo Dutt, a money-lender carrying on business at Calcutta and elsewhere, to secure the repayment of Rs. 20,000 at 12 per cent interest on some houses belonging to the respondent. The amount actually advanced is in dispute. At that time the respondent was an infant; and he did not attain twenty-one until the month of September following. Throughout the transaction Brahmo Dutt was absent from Calcutta, and the whole business was carried through for him by his attorney, Kedar Nath Mitter, the money being found by Dedraj, the local manager of Brahmo Dutt. While considering the proposed advance, Kedar Nath received information that the respondent was  still a minor; and on July15, 1895, the following letter was written and sent to him by Bhupendra Nath Bose, an attorney: â€Å"Dear Sir, I am instructed by S.M. Jogendranundinee Dasi, the mother and guardian appointed by the High Court of the person and property of Babu Dharmodas Ghose, that a mortgage of the properties of the said Babu Dharmodas Ghose is being prepared from your office. I am instructed to give you notice, which I hereby do, that the said Babu Dharmodas Ghose is still an infant under the age of twenty-one, and any one lending money to him will do so at his own risk and peril.† Kedar Nath positively denied the receipt of any such letter; but the Court of first instance and the Appellate Court both held that he did personally receive it on July 15; and the evidence is conclusive upon the point. On the day on which the mortgage was executed, Kedar Nath got the infant to sign a long declaration, which he had prepared for him, containing a statement that he came of age on June 17; and that Babu Dedraj and Brahmo Dutt, relying on his assurance that he had attained his majority, had agreed to advance to him Rs. 20,000. There is conflicting evidence as to the time when and circumstances under which that declaration was obtained; but it is unnecessary to go into this, as both Courts below have held that Kedar Nath did not act upon, and was not misled by, that statement, and was fully aware at the time the mortgage was executed of the minority of the respondent On September 10, 1895, the infant, by his mother and guardian as next friend, commenced this action againt Brahmo Dutt, stating that he was under age when he executed the mortgage, and praying for a declaration that it was void and inoperative, and should be delivered up to be cancelled. The defendant, Brahmo Dutt, put in a defence that the plaintiff was of full age when he executed the mortgage; that neither he nor Kedar Nath had any notice that the plaintiff was then an infant, that, even if he was a minor, the declaration as to his age was fraudulently made to deceive the defendant, and disentitled the plaintiff to any relief; and that in any case the Court should not grant the plaintiff any relief without making him repay the moneys advanced. Jenkins J., who presided in the Court of first instance, found the facts as above stated, and granted the relief asked. And the Appellate Court dismissed the appeal from him. Subsequently to the institution of the present appeal Brahmo Dutt died, and this appeal has been prosecuted by his executors. The first of the appellants’ reasons in support of the present appeal is that the Courts below were wrong in holding that the knowledge of Kedar Nath must be imputed to the defendant. In their Lordships’ opinion they were obviously right. The defendant was absent from Calcutta, and personally did not take any part in the transaction. It was entirely in charge of Kedar Nath, whose full authority to act as he did is not disputed. He stood in the place of the defendant for the purposes of this mortgage; and his acts and knowledge were the acts and knowledge of his principal. It was contended that Dedraj, the defendant’s gomastha, was the real representative in Calcutta of the defendant, and that he had no knowledge of the plaintiff’s minority. But there is nothing in this. He no doubt made the advance out of the defendant’s funds. But he says in his evidence that â€Å"Kedar Babu was acting on behalf of my master from the beginning in this matter;† and a little further on he adds that before the registration of the mortgage he did not communicate with his master on the subject of the minority. But he did know that there was a question raised as to the plaintiff’s age; and he says, â€Å"I left all matters regarding the minority in the hands of Kedar Babu.† The appellants’ counsel contended that the plaintiff is estopped by Section 115 of the Indian Evidence Act (I. of 1872) from setting up that he was an infant when he executed the mortgage. The section is as follows: â€Å"Estoppels. When one person has by his declaration act or omission intentionally caused or permitted another person to believe a thing to be true, and to act upon such belief, neither he nor his representative shall be allowed in any suit or proceeding between himself and such person or his representative to deny the truth of that thing.† The Courts below seem to have decided that this section does not apply to infants; but their Lordships do not think it necessary to deal with that question now. They consider it clear that the section does not apply to a  case like the present, where the statement relied upon is made to a person who knows the real facts and is not misled by the untrue statement. There can be no estoppel where the truth of the matter is known to both parties, and their Lordships hold, in accordance with English authorities, that a false representation, made to a person who knows it to be false, is not such a fraud as to take away the privilege of infancy: Nelson v Stocker [1 De G. & J. 458]. The same principle is recognised in the explanation to Section 19 of the Indian Contract Act, in which it is said that a fraud or misrepresentation which did not cause the consent to a contract of the party on whom such fraud was practiced, or to whom such misrepresentation was made, does not render a contract voidable. The point most pressed, however, on behalf of the appellants was that the Courts ought not to have decreed in the respondent’s favour without ordering him to repay to the appellants the sum of Rs. 10,500, said to have been paid to him as part of the consideration for the mortgage. And in support of this contention Section. 64 of the Contract Act (IX of 1872) was relied on: Both Courts below held that they were bound by authority to treat the contracts of infants as voidable only, and not void; but that this section only refers to contracts made by persons competent to contract, and therefore not to infants. The general current of decision in India certainly is that ever since the passing of the Indian Contract Act the contracts of infants are voidable only. This conclusion, however, has not been arrived at without vigourous protests by various judges from time to time; nor indeed without decisions to the contrary effect. Under these circumstances, their Lordships consider themselves at liberty to act on their own view of the law as declared by the Contract Act, and they have thought it right to have the case reargued before them upon this point. They do not consider it necessary to examine in detail the numerous decisions above referred to, as in their opinion the whole question turns upon what is the true construction of the Contract Act itself. It is necessary, therefore, to consider carefully the terms of that  Act; but before doing so it may be convenient to refer to the Transfer of Property Act (IV of 1882), s.7 of which provides that every person competent to contract and entitled to transferable property †¦ is competent to transfer such property †¦ in the circumstances, to the extent, and in the manner allowed and prescribed by any law for the time being in force. That is the Act under which the present mortgage was made, and it is merely dealing with persons competent to contract; and s. 4 of that Act provides that the chapters and sections of that Act which relate to contracts are to be taken as part of the Indian Contract Act, 1872. The present case, therefore, falls within the provisions of the latter Act. Then, to turn to the Contract Act, s. 2 provides (e) Every promise and every set of promises, forming the consideration for each other, is an agreement. (g) An agreement not enforceable by law is said to be void. An agreement enforceable by law is a contract, (i) An agreement which is enforceable by law at the option of one or more of the parties- thereto, but not at the option of the other or others, is a voidable contract Sect. 10 provides: â€Å"All agreements are contracts if they are made by the free consent of parties competent to contract, for a lawful consideration and with a lawful object, and are not thereby expressly declared to be void.† Then Sec. 11 is most important, as defining who are meant by â€Å"persons competent to contract;† it is as follows: â€Å"Every person is competent to contract who is of the age of majority according to the law to which he is subject, and who is of sound mind, and is not disqualified from contracting by any law to which he is subject. Looking at these sections, their Lordships are satisfied that the Act makes it essential that all contracting parties should be â€Å"competent to contract,† and expressly provides that a person who by reason of infancy is incompetent to contract cannot make a contract within the meaning of the Act. This is clearly borne out by later sections in the Act. Sec. 68 provides that, â€Å"If a person incapable of entering into a contract, or any one whom he is legally bound to support, is supplied by another person with necessaries suited to his condition in life, the person who has furnished such supplies is entitled to be reimbursed from  the property of such incapable person.† It is beyond question that an infant falls within the class of persons here referred to as incapable of entering into a contract; and it is clear from the Act that he is not to be liable even for necessaries, and that no demand in respect thereof is enforceable against him by law, though a statutory claim is created against his property. Under Section. 183 and 184 no person under the age of majority can enjoy or be an agent. Again, under Section. 247 and 248, although a person under majority may be admitted to the benefits of a partnership, he cannot be made personally liable for any of its obligations; although he may on attaining majority accept those obligations if he thinks fit to do so. The question whether a contract is void or voidable presupposes the existence of a contract within the meaning of the Act, and cannot arise in the case of an infant. Their Lordships are, therefore, of opinion that in the present case there is not any such voidable contract as is dealt with in Sec tion 64. A new point was raised here by the appellants’ counsel, founded on s. 65 of the Contract Act, a section not referred to in the Courts below, or in the cases of the appellants or respondent. It is sufficient to say that this section, like Section. 64, starts from the basis of there being an agreement or contract between competent parties, and has no application to a case in which there never was, and never could have been, any contract. It was further argued that the preamble of the Act showed that the Act was only intended to define and amend certain parts of the law relating to contracts, and that contracts by infants were left outside the Act. If this were so, it does not appear how it would help the appellants. But in their Lordships’ opinion the Act, so far as it goes, is exhaustive and imperative, and does provide in clear language that an infant is not a person competent to bind himself by a contract of this description . Another enactment relied upon as a reason why the mortgage money should be returned is Section 41 of the Specific Relief Act (I of 1877), which is as follows: â€Å"Sec. 41. On adjudging the cancellation of an instrument the Court may require the party to whom such relief is granted to make any compensation to the other which justice may require.† Sec.38. provides in  similar terms for a case of rescission of a contract. These sections, no doubt, do give a discretion to the Court; but the Court of first instance, and subsequently the Appellate Court, in the exercise of such discretion, came to the conclusion that under the circumstances of this case justice did not require them to order the return by the respondent of money advanced to him with full knowledge of his infancy, and their Lordships see no reason for interfering with the discretion so exercised.

Each word of these novels was a yellow brick ia the road to Oz. Some chapters I read and leread so as to repeat the dependable, out-of-body sensation of being someulzere ebe. I read addictively, constantly. On one-family vacation my father pleaded with me to close my book long enough to look at the Grand Canyon. I borrowed stacks of books from the public libraxy: novels, biographies, history anything that looked even remotely engaging. Along with pre-adolescence came a more pressing desire for escape. I read more widely, more indiscriminately, and mostly with an interest in how far a book could take me from my life and how long it could keep me there. Gone With rlze LVind Pearl Buck. I turned the pages of these Page-turners as fast as I could. Reading was like eating alone, with that same element of bingeing. I was fortunate to have good teachers, and friend. s who  were also readers. The books I read bdcame more chal’ lenging, betterwritten, more substantial. Sieinbe& Camus. Hemingway, Fiugerald, TWain, Salingea Arrne Frank. Litde beatniks, my friends and I were passionate fans of Jack Kerouac, Allen Ginsberg, Lawrence Ferlinghetti. We read . Truman Capote, Carson McCullers, and the proto-hippie classics of Herman Hesse, Carlos Castenada-Mary Poppiru for people who thought they’d outgrown the flying nanny. I-must have been vaguely aware of the power of language, but only dimly, and only as it applied to whatever effect the book was having on me.

This atmosphere of intolerance and rigid absolutism bred a particularly bitter anticlericalism; the perceived power machinations and profligacy of the clergy encouraged scathing denunciations of priestly hypocrisy and cynical manipulation. In relatively more tolerant Protestant England, such intense animosity was unlikely to arise. Nonetheless, the basic principles of enlightenment thought produced skeptical and crit ical accounts of revealed religion across national boundaries, and English deists were especially active in promulgating the foundation for a more rational, simplified, and less doctrinaire faith. The fact that the Indian speaking population in India is growing by the day means that India has become a hub of outsourcing activities for some of the major economies of the world including the United Kingdom and the United States. Outsourcing to India has been primarily in the areas of technical support and customer services. India is a vast country with different languages in different parts of the country. These regional languages differ from each other so much that it is not possible to communicate with people of other regions without a common language. Further, India is growing on all fronts whether it is social or economic angle. India is on the road to become a strong and prosperous nation in the world. India is trying to maintain a good foreign policy. For all this, there is need of a common language i.e., English. It is this language which is understood almost all over the region in addition to national language of Hindi, all schools and colleges teach English and mostly have it as a medium of instruction. In todays world, we have to get knowledge of advanced technologies and all kinds of branches of Science. There is an urgent need of such a common language which can be understood by youth all over India and the language in which all data and information is available. It is English only which can be rightly selected as the language to be studied by all of us from the very primary level. This language is a store house of social and political knowledge. Hence, study of English language is of great importance for a developing country like India. Without knowledge of this language, our technicians, mechanics and engineers cannot progress. Today, USA and other countries have made tremendous progress in the field of science and technology. In space technology, we are no match to them. The world is making progress in these fields at a terrific speed. To increase and encourage more research work in Science and Technology, we have to study all these subjects in detail. And for this the importance of English cannot be denied. Our own regional languages do not have the depth and capacity to understand and co relate all these technological developments and as such, cannot served the purpose to keep pace with the fast growing world outside. Most of the best books on all such subjects are available in English language only. We cannot translate it all in our own regional languages, therefore, knowledge of English can only prove to be a blessing. Some subject like Science, Mathematics and technology books must be taught in English only. This fact is being realized now by those who had opposed teaching in English few years ago. They now know that we have not been able to prosper like other countries of the world due to keeping ourselves away from English. It is this language which can uplift us not only within our own country but throughout the world. We will be no less than anybody in the world with knowledge of English. English in India is a legacy from the British who colonized the country and their language permeated through some of the most important parts of society: the government, the media, the education system, the legal system, and gradually the social sphere as well. India is a vast nation and in terms of number of English speakers, it ranks third in the world after USA and the UK. An estimated 4 percent of the population use English and even though this may seem like a small number that is about 40 million people. This small segment of the population controls domains that have professional and social prestige. It is certainly considered instrumental in terms of having access to information from all over the world and as a key factor for professional success, but it is also very much a part of the educated middle and upper class persons life especially of the youth in India. The Education System: In higher education English is the premier prestige language. Careers in any area of business or commerce, or within the government, or in science and technology require fluency in English. It is taught in schools ranging from the most elite private schools to small government schools because only this language is an acceptable medium of communication through the nation. A 2008 report by software lobby group Nasscom, have shown only 10-15% graduates are employable in business services and only 26% engineers in technical services due to educational deficiencies. English in India has, indeed, come far from its original uses in the colonial times when it was mostly used as the language of the government. Nowadays, English has spread into many new domains, also the more personal ones, such as the family and friendship. English has, also, acquired new functions, including the self-expressive or innovative function. Today, in fact, it is hard, almost impossible to think of English as it is used in India only simply as another foreign language. In the domains of education, government and employment English shows itself, without doubt, as the most preferred medium. The Future of English in India The language has already been well established in the country and has acquired its own independent identity. With the number of foreign investors flocking to India and the growth of outsourcing, English has come to play a key role in professional relationships between foreign and Indian companies. Familiarity with the differences between American and British English has definitely grown as much business communication is carried out according to the language style with which a client is comfortable. Now we go back and examine what would have happened had Hindi been the national languages, and with English sidelined. Many foreign companies would have come to India even if it was a Hindian nation, but in the absence of a sound knowledge of English, India would have been just been a trade hub, not something where development would take place. Indian companies would not have been able to export as much. India would not have become a development centre for the other nations. We would NOT have been recognised as a nation with huge, economic and quality human resource.We would not have been able to interact much with the world outside. IT companies, telecommunication companies, and other companies would not have decided to come to India. We would not have had Indian companies in these fields make their global footprint. Even now there are many countries which offer much cheaper labour than India, but the reason India became a outsourcing hub was because India managed to strike a very g ood balance between cost and quality. In fact this is very similar to what globalisation is currently doing in Africa. Given the current lack of exposure for technology in India, the lack of English knowledge would have only made it worse. The Indian education system places strong emphasis on mathematics and science, resulting in a large number of science and engineering graduates. Mastery over quantitative concepts coupled with English proficiency has resulted in a skill set that has enabled India to reap the benefits of the current international demand for IT. India is capitalizing on its large numbers of well-educated people skilled in the English language to become a major exporter of software services and software workers, As the economy expands, Indias job recruitment market is also expected to grow in line and double at Rs 2,000 crore in the next five years, a top industry official said. The growth in Indias economy has helped bring about a tremendous growth in the manufacturing, banking and services sectors in the country. The job recruitment market here is set to grow at 20 per cent per annum and touch the Rs 2,000 crore mark in five years from the present Rs 1,000 crore, Esource Indias Managing Director Nitin Deveshwar told PTI here. To improve the job quotient for the jobseekers in the burgeoning economy, they need to keep themselves abreast with the latest trends in the dynamic market.This gap is shortened by the various mode of teaching is also taught through internet enabled websites.There are various web sites which can enhance the skill sets of the potential job seekers to the required level. Modernism And Modernisation In Architecture And Culture Philosophy Essay Discuss the various competing notions of Modernity, Modernism and Modernisation in architecture and culture in the writings of Robert Venturi/Denise Scott Brown using the writings of Michel Foucault and Jà ¼rgen Habermas to support your discussion. Introduction To begin this essay concerned with the issues of Modernity, Modernism and Modernisation, I think it is a necessity to first define the term Modern, as it links all three terms. Modern, according to Jà ¼rgen Habermas, was first used in late fifth century in order to distinguish the Christian present, from the pagan and Roman past. He argues that Modern can be used whenever the awareness of a new era developed in Europe through a change in the relationship to classical antiquity. For us people today, Habermas thinks modern begins with the Renaissance, however people considered themselves as modern in the age of Charlemagne in the twelfth century and in the Enlightenment. (Habermas, 1996). Through this Habermas describes the term modern as one, which can be used widely and has no definitive time period, as the concept behind it is based upon ones (or an eras) perception. Figure Habermas explanation of modern is supported by Vincent Scully, as he explains that Le Corbusiers, a pioneer of Modern architecture, teacher was the Greek temple (Figure 1), consisting of an isolated body, white and free in the landscape, its rigour clear in the sun. Le Corbusier during his early polemics would have his buildings just as the temple, as time went on his architecture began to progressively more and more incorporate the Greek Temples sculptural and heroic character. (Venturi, 1977) Scullys interpretation on the work of Le Corbusier directly, as Corbusier created a new direct relationship with the classical antiquity of Greek Temples. Michel Foucault, according to Barry Smart, takes a slightly different perspective to Habermas and Scullys interpretations of the term modern, he interprets modern as a placeholder when a more definite description is not known. He goes on to explain that the modern (or present) cannot recognise itself as a period and that if you can outline the characteristics that make up a period is to already be beyond it and has become the past. (Smart, 1994). Foucault an interesting insight into the modern, as simply a title giving to that which is unclassifiable , the present, and that once you can classify a time period then it is no longer modern and is the past. Modernity 1.1 Habermas argues that Modernity is an expression that represents the consciousness of an era that relates back to the past of classical antiquity in order understand itself as the movement from the old to the new. What Habermas called the Unfinished Project aims at a distinguishable reconnection of modern culture with an everyday sphere of the theory production process, which is dependent on living heritage. However, the aim of modernity can only be achieved if the process of social modernisation can be transformed into other non-capitalist directions, if the state of the current world is capable of developing institutions of its own way currently withdrawn by the self-ruling system dynamics of the economic and administrative systems. (Habermas, 1994) Venturi explains that Louis Khans or orthodox modern architects desire for simplicity, is satisfactory, when it is made valid through inner complexity. He goes to mention that the Doric Temples (Figure 2) simplicity to the eye is achieved through famous subtleties and precision of its distorted geometry and the contradictions and tensions inherent in its order, so it achieves apparent simplicity through real complexity. (Venturi, 1977). Through this Venturis point links directly to Habermas notion of modernity, as he is relating the new Modern architecture desire for simplicity to the simplicity achieved in the old architecture of the Doric Temple, thereby highlighting a transition from the old to new. Figure Michel Foucault takes a different approach from Habermas as he denotes Modernity as something which is characterised by a combination of power/knowledge relations around the subject of life, a life that is now possible to master through science. He goes on to argue that the human races problem does not only consist of a fear of destruction through chemical or atomic pollution, animal species extinction or depletion of natural resources; the idea that any malicious power could take over technologies for evil purposes, is only a false illusion to hide a genuine metaphysical anxiety that corresponds with the mastery of life. Through this Foucault states that this mastery of life, through science, transforms the living, crushing it. As opposed to turning it into a knowledge base upon which could support us, thus making the living being more and more artificial. (Jose, 1998) Habermas produces a definition of Modernity, which takes a more of social/economical perspective, with his relation between social modernization and capitalism and between the worlds institutions and autonomous economic and administrative systems. On the other hand Foucault takes an approach in which he addresses how important the scientific aspect of modernity is and how it has affected out outlook on life as a whole. Figure According to Habermas, Georg Wilhelm Friedrich Hegel (Figure 3) was the first philosopher to develop a clear understanding of modernity. With the philosophers that came before him, Hegel located the core of modernity in the principle of subjectivity, which had previously been discussed by Kant, who saw subjectivity as the foundation of science, morality and art fields. Hegel argued that since modernity was based on subjectivity and the power of critical reflection, only philosophical reason could achieve the hoped-for reconciliation and overcome the doubt of modern subjectivity. This interpretation lead to the articulation of Hegels notion of absolute spirit, which is the consuming activity of self-discovery, the unconditionally self-productive self-relation, interceding subjectivity and objectivity, nature and spirit, finitude and infinity. (Habermas, 1996, Pg. 6) Modernity and the Enlightenment David Harvey describes Enlightenment thought as that which embraced the idea of progression and actively wanted that break with history and tradition which modernity adopts. It was a non-religious movement that sought the removal of obscurity and sacredness of knowledge and social organisation in order to free human beings from their chains. (Harvey, 1989). The project of modernity, as referred to by Habermas, came into focus during eighteenth century. This developed an intellectual effort by Enlightenment thinkers to advance in objective science, universal ethics and law, and autonomous art according to their inner logic. The idea behind this was to may use of the knowledge gained by many people working freely and creatively in pursuit of human emancipation and the enrichment of daily life. Harvey denotes Enlightenment thought as a thought process which strives to remove the unease about pursuing knowledge and social organisation so that we can remove the chains in our minds, which prevents us from gaining more knowledge. This links into Habermas, where he touches upon a characteristic of Enlightenment thinking, which is to advance and enrich daily life through the gain of more knowledge. According to Habermas, through opposing the classical and the romantic to each other, modernity wished to create its own past in an idealised vision of the Middle Ages. During the nineteenth century the Romanticism produced a radicalised realisation of modernity that detached itself from all previous historical connections and understood itself solely in abstract opposition to tradition and history as a whole. (Habermas, 1996) I do not agree with this statement as Habermas contradicts himself as he previously denoted modernity as an expression that represents the consciousness of an era that refers back to the past of classical antiquity precisely in order to comprehend itself as the result of a transition from the old to the new. (Habermas,1996, Pg. 39) With reference to this notion, it would impossible for a type of modernity to develop that not have historical connections and abstractly opposed tradition and history entirely. Modernity as an avant-garde The mentality of aesthetic modernity began to form with Charles Pierre Baudelaire and with his theory of art, which had been influenced by Edgar Allan Poe. This unfolded in the avant-garde artistic movements and then achieved its peak with surrealism and the Dadaists of the Cafà © Voltaire. This mentality is characterised by a set of attitudes, which formed around a new transformed consciousness of time, which expresses itself in the spatial metaphor of the avant-garde. This avant-garde explores the unknown, thereby exposing itself to the risk of sudden and shocking encounters, conquering an undetermined future and must find a path for itself in previously unknown domains. The Challenges of Middle East Collection Librarianship The life of a Middle East collections librarian is typically one of quiet cataloging balanced with defensive declarations of one's significance to a great many co-workers and fellow university folk who fail to understand the need to collect items in "those squiggly languages." In an effort to share ideas on how to gain greater respect among peers while serving patrons as best as possible, hard-working Middle East librarians across the United States and the world commiserate on listservs and attend the annual Middle East Librarian Association (MELA) conference. They often discuss the new and the continuing obstacles to this specialty reaching its full potential and obtaining its due respect. Censorship is an issue. Books are usually censored upon publishing, but the censors can change their minds†¦ Primary among concerns is money. Also, few things speak so clearly about what the library prizes than does space allocation. Middle East collections are frequently in the inner, dark depths, the highest reaches, or the most backward rooms of the libraries that contain them. Certified librarians regularly receive greater deference and respect within the library organizational structure, particularly those with bureaucratic (role) systems (Handy 185). But professionals cost more, so hiring students is an established practice. But, if finding qualified personnel is a problem at Princeton University, which has an endowment of 3.5 billion dollars, it is almost certainly a problem everywhere (Weinberger). Finally, respect infrequently comes from the lofty positions beyond the library walls. Presidents, Provosts, and Regents often fail to perceive the library as an essential, perpetually developing aspect of campus life. The core of the problem may be that the people making the decisions in libraries and in administrations do not see a need for a library because they do not visit it. This divide might best be bridged by personally inviting these leaders to annual report meetings, presentations, or displays related to your collection. When they do not at first respond--and they likely will not--display a bit of personal power (Handy 131) and continue to invite them. If they regularly receive things in your name, their curiosity may eventually get the better of them. Challenges specific to the Middle East Librarianship include: - Cataloging challenges - Delays of copy cataloging - Student-dependent work - Nothing arriving shelf- - On-line materials - A host of supply problems. Cataloging challenges center around transliteration systems, a marked dependency by more and more institutions on copy cataloging, and a shift from relying on expert catalogers to the growing use of student workers.

An Interview With a Korean-American on Cultural Differences In this interview Ben Bagley asks Theresa Han about the difference between Korean and American culture. Theresa is a teenager who recently moved to the United States so she has an excellent perspective for understanding the differences and similarities between these countries. [BAGLEY] This is Ben Bagley, and I'm going to interview Theresa Han about Korea. Could you introduce yourself? [HAN] My name is Theresa Han, I'm from South Korea, I'm 18 years old, and I'm a freshman in College. [BAGLEY] How long have you lived in America? [HAN] I think a little bit less than 3 years. [BAGLEY] Where did you live in Korea? [HAN] I lived in Pyoung Tek, It's right below Oosan, where the American Air force is located. [BAGLEY] What were the people like where you lived? [HAN] They're really busy. Fathers go to their work; Mothers if they have a job go to their work, and students go to school, so they don't have enough time to communicate with each other, like time to spend together, because mostly students come home like 10:00pm-11:00pm. [BAGLEY] What did you do with your friends? [HAN] We mostly go to each other's house, rent a movie or something, watch it, and do homework usually, because we have a whole bunch of homework. On the weekends we would go downtown; it's kind of like a shopping mall. It's a street. There are small restaurants, small cloths shops and all that stuff. It was kind of fun, but nothing special I think. [BAGLEY] What did you do in your free time? [HAN] Mostly watch TV I guess. [BAGLEY] What was Korean TV like? [HAN] Like on Japanese TV they have a whole bunch of dramas, so there are Korean dramas, there is regularly a music program, like 3 music programs on 3 different channels. I mostly watched them, like almost everyday. [BAGLEY] Was American TV available in Korea? [HAN] Yeah, there's channel 2, so I know like 'Wheel of Fortune' or whatever. And 'The Simpsons' was on channel 15, it was the educational channel, but ?The Simpsons?Ewas on it in Korean, so I sometimes watched it. [BAGLEY] And was that dubbed or with subtitles? [HAN] I think it was dubbed in Korean, because I had never heard how Homer really talks. [BAGLEY] What is Korean music like? [HAN] There are a lot of kinds of music. Like rock, like f... ...uitoes. [BAGLEY] Which country has a greater temperature difference throughout the year? [HAN] In Korea the summer is so hot, and the winter is so cold. Really cold, so they are so different. In America the temperatures stay closer together, it?s way better. [BAGLEY] Are there any other big differences between Korea and America? [HAN] I think the school system, because basically you go there, I went to school usually by 7:30am and came home 7:00pm. But some students stay longer, like even 10:00pm if you are a senior and about to go to college because there is kind of, like parents and teacher think their kids or students should go to college. Like have to go to college. They?re gonna pressure them to study a lot, so when you?re a senior you start to study a lot and you don?t sleep that much. Usually I think some people sleep 3 or 4 hours per day and just study. No free time. [BAGLEY] And they stay at school and study? [HAN] ?Till like 10:00pm but after school ends they come home and study like until 2:00am or 3:00am [BAGLEY] Would it be ok if I publish this interview on the internet? Hacienda Luisita Issue

The documentaries about Hacienda luisita are serve a lesson for all of us. While watching the documentary I feel pity to all farmers of hacienda luisita because they will fight for what they think is right. And I really admired them for their undying love for the land they needed for their lives. On January 22 1987 when mendiola massacre happen, some 10,000 farmers marched to ask the President Corazon Aquino to make good on her promise to implement a genuine agrarian reform program. Mendiola Bridge was the center of many a protest in the country since the time of Mrs. Aquino's. Its proximity to the Palace assured demonstrators that their calls might be better heard. But on that day, it was the sound of bullets firing and screams from the farmers that echoed in the streets outside the presidential palace. Within a few minutes, 13 farmers lay dead. At least 39 others sustained gunshot wounds, while 20 suffered minor injuries. The media called it â€Å"Black Thursday† but it went down in history as â€Å"The Mendiola Massacre. People died protecting the land they had treated as their own. Risking their lives and losing their lives for the land showed how their lives would be meaningless or impossible without it. Sadly, lives were lost before this was made clear to the public. But that’s not the end of the the tragedy. The workers launched their strike again on November 6, 2004, two unions led the strike. The strikers were forced to contend with the b iggest number of police and military. They stood their ground against tear gas and chemical-laced water that stung when it hit their skin. Many were hurt. At the final count, 72 were badly injured, 27 sustained gun shot wounds, and 110 were arrested by the police. By early evening, it was also discovered that seven were killed. It hurts for me to know that our own policeman killed there fellow Filipino. Eventually the policeman responsibility is to protect there fellow citizen but then they are the tool to lose the life of there countryman. I hope that sooner the Cojuanco family would somehow realize that there are many Filipinos particularly the people in tarlac who are living around the Hacienda Luisita are striving to have even a part of land that they could till. May they also be reminded that if they have a huge part of land which they could no longer manage, then it should be given to poor people who need it the most. I hope someday the farmers of hacienda luisita can get the justice they looking for, and I hope between cojuanco and the farmers well talk peacefully to avoid losing life again.

Structuration theory

Anthony Giddens was born on January 8, 1938. He is a British sociologist who is known for his theory of structuration and his holistic view of modern societies. He is considered to be one of the most prominent modern sociologists, the author of at least 34 books, published in at least 29 languages, issuing on average more than one book every year. In 2007, Giddens was listed as the fifth most-referenced author of books in the humanities.He has served as Director of the London School of Economics in 1997 until 2003. Structure is defined by Giddens as rules and resources, organized as properties of social systems. The theory of structuration is a social theory of the creation and reproduction of social systems that is based in the analysis of both structure and agents without giving primacy to either. In other words, when we communicate with one another, we create structures that range from large social and cultural institutions to smaller individual relationships.As communicators act strategically according to rules to achieve their goals, they do not realize that they are simultaneously creating forces that return to affect future ction. Structures like relational expectations, group roles and norm, communication networks and societal institutions affect social action. But these variables may also both affect and are affected by social action. These structures provide individual with rules that guide their actions, but their action in turn create new rules and reproduce old ones. Figure 1: Variables of the theory. 2.ORIGINS OF STRUCTURATION THEORY Sociologist Anthony Giddens adopted a post-empiricist frame for his theory, as he was concerned with the abstract characteristics of social relations. This leaves each evel more accessible to analysis via the ontologies which constitute the human social experience: space and time and thus, in one sense, ‘history'. His aim was to build a broad social theory which viewed basic domain of study of the social science s neither the experience of the individual actor, not the existence of any form of societal totality, but social practices ordered across space and time.His focus on abstract ontology accompanied a general and purposeful neglect of epistemology or detailed research methodology. Giddens used concepts from objectivist and subjectivist social theories, discarding bjectivism's focus on detached structures, which lacked regard for humanist elements and subjectivism's exclusive attention to individual or group agency without consideration for socio-structural context. 3.DUALITY OF STRUCTURE Structuration theory may be seen as an attempt to resolve a fundamental division within the social sciences between those who consider social phenomena as determined by the influence of objective, exogenous social structures and others who see them as products of the action of human agents in the light of their subjective interpretation of the world. Giddens attempts to square this circle by proposing that tructure and agency be viewed, not as independent and conflicting elements, but as a mutually interacting duality.Social structure is therefore seen as being drawn on by human agents in their actions, while the actions of humans in social contexts serve to produce, and reproduce, the social structure. Structure is thus not simply an exogenous restraining force, but is also a resource to be deployed by humans in their actions, it is enabling as well as disabling. More specifically, Giddens identifies three dimensions of structure, which are signification, domination and legitimation. The three dimensions of interaction are described as communication, power and sanctions.The means by which structures are translated into actions are called modalities, which are interpretive schemes, facilities and norms as shown in Figure 2. These modalities can explain why and how interaction is affected. Figure 2: Dimensions of the duality of structure, Giddens (1984) For example, as humans comm unicate, they use interpretive schemes to help them make sense of their interaction; at the same time these interactions change or reproduce the same interpretive schemes that are embedded in structures as signification.The facility used to allocate resources is manifested in the wielding of power, which in turn produces and reproduces facilities influencing social structures of domination. Norms on the other hand, referred to also as moral codes; provide both understandings and sanctions for human interactions, ultimately also producing legitimation within structures. 4. APPLICATION OF THE THEORY Donald Ellis (1999) shows how ethnicity is entailed in structuration. Ethnicity is a structural arrangement created over time as a result of many local practices throughout the world.Yet, once created, ethnicity has a life of its own, so that it ecome almost impossible not to see and act in accordance with ethnic experience in some way or another. Well intentioned people acting in their ev eryday live create unintended categories of social structure, which is limit what they can do in future interactions. these structures are not necessarily bad, but they can limit the ability to see a range of possibilities for acting in future situations 4. 2 Communication : Decision making Marshall Scott Poole (1985) and his colleagues have been working for several years on her structurational theory of group decision making.This theory teaches that group ecision making is a process in which group members attempt to achieve convergence or agreement on a final decision and in so doing structure their social system. By expressing their opinions and preferences, group member actually produce and reproduce certain rules by which convergence can be achieve or blocked. However, good decision making depends on three set of variables that are objectives task characteristics, group task characteristics and group structural characteristics.Figure 3 : Variables of the theory in term of Group Decision Making.   Adaptive structuration Theory Desancns and Poole (2011) adapted Structuration Theory to study the interaction of groups and organizations with information technology, and called it Adaptive Structuration Theory (AST). Adaptive Structuration Theory is formulated as the production and reproduction of the social systems through members use of rules and resources in interaction. This theory criticizes the technocentric view of technology use and emphasizes the social aspects.Individual interaction with technology and in the incorporation personal experiences can dictate outcomes and structural change as well as eventually change the design or use of the technology. The theory could be used to analyze the advent of various innovations such as the printed press, electricity, telegraph, mass transpirations, radio, telephone, TV, the Internet, etc. , and show how the structures of these innovations penetrated the respective societies, influencing them, and how the socia l structures of those societies in turn influenced and modified innovations ongtnal intent. Thompson (said that Structuration theory needed to be more specific and more consistent both internally and with conventional social structure theory. Thompson focused on problematic aspects of Giddens' concept of structure as â€Å"rules nd resources,† focusing on â€Å"rules†. He argued that Giddens' concept of rule was too broad. Discovers the meso-level of ontology between the abstract, philosophical level of ntology and the in-situ, ontic level. Strong structuration allows varied abstract ontological concepts in experiential conditions. 5. Focuses on the meso-level at the temporal and spatial scale. . Conceptualises independent causal forces and irresistible causa l forces, which take into account how external structures, internal structures, and active agency affect agent choices (or lack of them). â€Å"Irresistible forces† are the connected concepts of a horizon of action with a set of â€Å"actions-in-hand† and a hierarchical ordering of purposes and concerns. An agent is affected by external influences. This aspect of strong structuration helps reconcile an agent's dialectic of control and his/her more constrained set of â€Å"real choices. As a conclusion, in structuration theory, neither micro nor macro focused analysis alone are sufficient. The theory most significantly in the constitution of society, which examines phenomenology, hermeneutics, and social practices at the inseparable intersection of structures and agents.
